1. Purpose
These terms of use govern the use of the FlashDeal mobile app, published by the publisher identified in the legal notice. By creating an account, you accept these terms without reservation.
2. Description of the service
FlashDeal is a platform connecting individuals that lets you:
- resell tickets and already-booked activities you can no longer use (concert, match, show, restaurant, spa…);
- publish time-limited, geolocated offers ("deals") lasting 15 minutes to 7 days — including items and flash promotions;
- discover nearby deals (by swiping or on a map) and reserve them;
- chat within the app to arrange an in-person handover.
FlashDeal is not a party to any transaction. Payment is made directly between buyer and seller, in person, by any means they choose. No commission is charged and no payment goes through the app.
3. User account
- Creating an account requires a valid email address and a username. The phone number is optional.
- The service is restricted to people aged 18 or over, or 15 or over with the permission of their legal guardians.
- You are responsible for keeping your credentials confidential and for all activity on your account.
- One account per person; automated or impersonating accounts are forbidden.
4. Publishing deals
By publishing a deal, the seller undertakes to:
- describe the offer honestly (condition, real photos, price, booking conditions where relevant);
- have the right to sell or transfer what they offer;
- honour accepted reservations or cancel them explicitly;
- not publish forbidden content or items: counterfeits, weapons, narcotics, medicines, animals, stolen goods, unlawful, hateful or sexual content, or any disguised professional business activity.
Every deal expires automatically at the end of its countdown. The publisher may remove without notice any content that breaches these terms.
5. Reselling tickets and bookings
The resale of tickets for shows, sporting or cultural events is strictly regulated by French law (in particular article 313-6-2 of the French Criminal Code). By publishing such a listing, the seller undertakes to:
- only transfer tickets occasionally, as an individual unable to attend the event;
- not make it a habitual or profit-seeking activity without the organiser's express authorisation;
- transfer tickets at no more than the price paid (face value, fees included);
- comply with the organiser's transfer conditions (named tickets, official transfer where applicable);
- for named bookings (restaurant, spa, activity…), check with the provider that the beneficiary can be changed.
Listings breaching these rules will be removed and may lead to account suspension. Buyers are advised to check the ticket's validity during the in-person handover, before paying.
6. Reservation and transaction
- Reserving a deal expresses an intention to buy but does not constitute a sales contract: the sale is concluded at the in-person handover.
- Buyer and seller freely agree on the place and time of the meeting. We recommend choosing a public place and checking the item or ticket before paying.
- Repeatedly failing to honour reservations may lead to account suspension.
7. Liability
The publisher uses reasonable means to keep the service available and secure, without guaranteeing uninterrupted operation. As host of user-published content, its liability can only be engaged from the moment a manifestly unlawful content is reported and not promptly removed.
The publisher is not liable for: the quality, conformity, validity or lawfulness of the items, tickets and bookings offered; an organiser's or provider's refusal to honour a transferred ticket or booking; how meetings between users unfold; payment disputes, which are exclusively a matter for the parties to the transaction.
8. User behaviour
The following are forbidden, among others: harassment through the chat, abusive or discriminatory speech, spam, scam attempts, collecting other users' data, and any misuse of geolocation. Any breach may lead to suspension or deletion of the account, without prejudice to possible legal action.
9. User content
You keep ownership of the photos and text you publish. You grant the publisher a non-exclusive, free, worldwide licence to host, reproduce and display this content, strictly as needed to run the service and for its duration.
10. Personal data
The processing of personal data is described in the privacy policy.
11. Account deletion
You can delete your account at any time from the app, or by requesting it through the Delete my account page. Deletion erases your data under the conditions set out in the privacy policy.
12. Changes to these terms
The publisher may update these terms. Users will be notified in the app of any substantial change; continued use constitutes acceptance of the new terms.
13. Governing law
These terms are governed by French law. In case of dispute, an amicable solution will be sought before any legal action. In case of discrepancy between language versions, the French version prevails.
